Welcome to Modern Primary Care Plus (“Modern Primary Care Plus,”, “Modern PC Plus”, “we,” “our,” or “us”). These Terms and Conditions (“Terms”) govern your use of our website, online forms, membership information, telehealth-related communications, appointment requests, and related services.

By accessing this website, submitting information, requesting services, enrolling in a membership, or using any part of this website, you agree to these Terms.

If you do not agree with these Terms, please do not use this website.

1. Website Information Is Not Medical Advice

The information on this website is provided for general educational and informational purposes only. It is not intended to replace professional medical advice, diagnosis, treatment, or emergency medical care.

Nothing on this website should be used as a substitute for direct medical evaluation by a qualified healthcare provider.

Use of this website, submission of a form, sending an email, requesting information, or reviewing service pages does not, by itself, create a provider-patient relationship.

A provider-patient relationship is established only after Modern Primary Care Plus accepts you as a patient and all required intake, consent, registration, and payment steps are completed.

2. Medical Emergencies

Modern Primary Care Plus is not an emergency medical provider.

If you are experiencing a medical emergency, call 911 immediately or go to the nearest emergency room.

Do not use website forms, email, text messaging, appointment requests, telehealth platforms, or other non-emergency communication channels for urgent or life-threatening medical issues.

3. Eligibility

Modern Primary Care Plus is intended for adults age 18 and older.

By using this website, requesting services, or enrolling in a membership, you represent that you are at least 18 years old and legally able to enter into these Terms.

Services are subject to provider availability, clinical appropriateness, patient location, licensure rules, and applicable law.

4. Services

Modern Primary Care Plus provides modern primary care, telehealth-first care, men’s health services, and related healthcare services.

Services may include, depending on clinical appropriateness and provider discretion:

  • Primary care visits
  • Telehealth visits
  • In-person visits
  • Membership-based care
  • Men’s health consultations
  • Lab and imaging referrals
  • Prescription and medication management
  • Referrals to specialists or outside providers
  • Preventive care and wellness guidance
  • Other services listed on the website or made available by the practice

The specific services available to you may depend on your membership status, visit type, medical condition, location, provider judgment, and applicable law.

Modern Primary Care Plus does not guarantee any specific diagnosis, treatment, medication, prescription, outcome, referral, or result.

5. Telehealth-First Care

Modern Primary Care Plus is a telehealth-first practice.

Telehealth may involve video, phone, secure messaging, digital intake forms, or other electronic communication tools used to evaluate, diagnose, treat, or coordinate care.

Telehealth may not be appropriate for every condition. The provider may determine that an in-person visit, physical exam, urgent care visit, emergency room visit, specialist referral, lab work, imaging, or other evaluation is needed.

You are responsible for providing accurate information about your identity, location, symptoms, medications, allergies, medical history, and current condition.

You are also responsible for having a reliable internet connection, compatible device, and private location when participating in a telehealth visit.

6. Optional In-Home Visits

Modern Primary Care Plus may offer optional in-home provider visits for an additional fee of $99, within a 15-mile radius, when available and clinically appropriate.

In-home visits are subject to provider availability, scheduling, location, safety, clinical appropriateness, and practice approval.

Modern Primary Care Plus reserves the right to decline, reschedule, or convert an in-home visit to telehealth or another care option when appropriate.

The $99 in-home visit fee is separate from membership fees, one-time visit fees, outside services, labs, imaging, medications, or other third-party costs unless otherwise stated.

7. Membership Options

Modern Primary Care Plus may offer membership options, including:

Membership

  • $99 per month for Adults Ages 18-44
  • $179 per month for Adults Ages 45+
  • $399 per month for 3 Member Family

Memberships have a 3-month minimum membership period unless otherwise stated in a signed membership agreement or required by applicable law.

The 3 Member Family membership applies to up to three eligible members as approved by Modern Primary Care Plus during enrollment.

Membership pricing, included services, and eligibility may be updated from time to time. Current membership details will be provided during enrollment.

8. One-Time Visit Options

Modern Primary Care Plus may offer one-time visit options, including:

  • $79 Telehealth Visit
  • $149 In-Person Visit

One-time visits do not include membership benefits unless specifically stated.

A one-time visit does not guarantee ongoing care, future availability, prescription refills, continued provider access, or enrollment in membership services.

The provider may recommend follow-up care, membership enrollment, additional evaluation, lab work, imaging, specialist referral, urgent care, or emergency care when clinically appropriate.

9. Direct Health Care Agreement

Membership enrollment may require a separate Direct Health Care Agreement, membership agreement, patient agreement, consent form, or enrollment document.

If there is a conflict between these website Terms and a signed membership agreement, the signed membership agreement will control for membership-related matters.

Any Direct Health Care Agreement or membership agreement should clearly describe the services covered by the membership fee, services not covered, fees, duration, renewal terms, termination rights, payment terms, and any required legal notices.

10. Required Notice: Not Insurance

Modern Primary Care Plus membership is not health insurance.

Membership does not replace health insurance, Medicare, Medicaid, workers’ compensation insurance, catastrophic coverage, specialist care, hospital care, emergency care, urgent care, prescription coverage, lab coverage, imaging coverage, surgery, or other healthcare services not provided by Modern Primary Care Plus.

Unless otherwise stated in a signed agreement, Modern Primary Care Plus does not file insurance claims for services covered by membership.

You are encouraged to maintain health insurance or other appropriate healthcare coverage for services outside Modern Primary Care Plus.

Any signed membership agreement should include the legally required notice applicable to direct health care agreements.

11. Services Not Included

Unless specifically stated in writing, membership and one-time visit fees do not include:

  • Emergency room care
  • Hospital care
  • Urgent care outside Modern Primary Care Plus
  • Specialist visits
  • Surgery
  • Ambulance services
  • Lab fees charged by outside labs
  • Imaging fees charged by outside facilities
  • Prescription medication costs
  • Pharmacy costs
  • Durable medical equipment
  • Vaccines or supplies not provided by the practice
  • Third-party platform fees
  • Services from outside providers
  • Insurance premiums, deductibles, copays, or coinsurance
  • Any service not listed as included in your membership or visit fee

Modern Primary Care Plus may help coordinate referrals, labs, imaging, or outside services, but third-party providers and facilities are independent and may bill you separately.

12. Labs, Imaging, Prescriptions, and Referrals

Modern Primary Care Plus may order, recommend, or refer you for lab work, imaging, medications, specialist care, or other outside services when clinically appropriate.

You are responsible for any costs charged by outside labs, imaging centers, pharmacies, specialists, hospitals, or other third parties.

Prescription decisions are made by the provider based on medical judgment, clinical appropriateness, applicable law, and patient safety.

Modern Primary Care Plus does not guarantee that any medication, including medications for men’s health, testosterone, erectile dysfunction, hair loss, weight management, or other concerns, will be prescribed.

Controlled substances may be limited or unavailable through telehealth or through the practice. The provider may decline to prescribe any medication when not clinically appropriate or legally permitted.

13. Appointments and Scheduling

Appointments are required unless otherwise approved by the practice.

Appointment availability may vary based on provider schedule, patient demand, visit type, location, clinical needs, and other factors.

Modern Primary Care Plus may offer same-day or next-day availability when possible, but no specific appointment time, response time, provider availability, or after-hours access is guaranteed.

If you need to cancel or reschedule an appointment, please contact us as soon as possible.

Repeated missed appointments, late cancellations, inappropriate use of services, nonpayment, or violation of these Terms may result in fees, suspension, or termination of services.

14. Communication

Modern Primary Care Plus may communicate with you by phone, email, text message, patient portal, telehealth platform, website form, or other communication method.

Email and standard text messaging may not be fully secure or confidential. For sensitive medical information, use secure communication channels provided by the practice when available.

Non-urgent messages will be addressed as reasonably possible during normal practice operations. Modern Primary Care Plus does not guarantee immediate responses.

For urgent or emergency medical concerns, call 911 or seek emergency care.

15. SMS and Text Messaging Terms

By providing your mobile phone number, you consent to receive text messages from Modern Primary Care Plus related to customer care, appointment reminders, membership communication, service updates, and important practice notifications.

Message frequency may vary. Message and data rates may apply.

You may opt out of text messages by replying STOP. For help, reply HELP or contact Modern Primary Care Plus directly.

We do not sell, rent, or share SMS opt-in consent or mobile phone numbers with third parties or affiliates for their own marketing purposes.

16. Payment Terms

You agree to pay all fees associated with your membership, one-time visits, in-home visits, and any other services you request or receive.

Payment may be collected through a third-party payment processor, membership platform, patient portal, or other approved payment method.

By submitting payment information, you authorize Modern Primary Care Plus or its payment processor to charge the applicable fees.

Membership fees may be billed monthly and may automatically renew unless canceled according to the cancellation terms in your membership agreement or these Terms.

You are responsible for keeping payment information current.

If payment fails, Modern Primary Care Plus may suspend or terminate membership benefits, cancel appointments, require payment before services are provided, or pursue collection of unpaid amounts where permitted by law.

17. Cancellation and Termination

Memberships have a 3-month minimum membership period unless otherwise stated in your signed membership agreement or required by law.

After the minimum membership period, either you or Modern Primary Care Plus may terminate the membership by providing at least 30 days’ advance written notice, unless a signed agreement provides otherwise or applicable law requires a different process.

Modern Primary Care Plus may immediately suspend or terminate services for nonpayment, abuse of staff, inappropriate conduct, fraudulent information, misuse of services, violation of the provider-patient relationship, safety concerns, or breach of these Terms.

If you cancel during a billing period, fees already paid for that billing period may be nonrefundable unless otherwise stated in writing or required by law.

If Modern Primary Care Plus ceases offering the covered healthcare services for which advance monthly fees were paid, any required refund of advance fees will be handled in accordance with applicable law and your signed agreement.

18. Refunds

Membership fees, one-time visit fees, and in-home visit fees are generally nonrefundable once the applicable billing period or service has begun, unless otherwise stated in writing or required by law.

Refunds, if any, are handled at the discretion of Modern Primary Care Plus and subject to applicable law, signed agreements, payment processor rules, and the specific circumstances.

Third-party fees charged by outside platforms, labs, imaging centers, pharmacies, specialists, or other providers are not controlled by Modern Primary Care Plus and may not be refundable through us.

19. Patient Responsibilities

You agree to:

  • Provide accurate and complete information
  • Update your contact, payment, and medical information as needed
  • Disclose current medications, allergies, conditions, symptoms, and relevant medical history
  • Follow provider instructions and care plans
  • Ask questions if you do not understand medical advice
  • Use services appropriately and respectfully
  • Treat providers, staff, contractors, and other patients with courtesy
  • Avoid using services for emergencies
  • Pay all applicable fees
  • Comply with these Terms and any signed patient or membership agreement

Modern Primary Care Plus may decline or discontinue care if accurate information is not provided or if continued care is not clinically appropriate or safe.

20. Website Use

You agree not to use this website for any unlawful, abusive, harmful, fraudulent, or disruptive purpose.

You may not:

  • Submit false or misleading information
  • Attempt to gain unauthorized access to the website or systems
  • Interfere with website security or functionality
  • Upload malicious code, spam, or harmful content
  • Copy, reproduce, or misuse website content without permission
  • Use the website to harass, threaten, defame, or abuse others

Third-party websites and platforms are not controlled by Modern Primary Care Plus. They may have their own terms, privacy policies, fees, security practices, and data collection practices.

Modern Primary Care Plus is not responsible for third-party websites, platforms, content, services, fees, errors, outages, or privacy practices.

You should review third-party terms and policies before using those services.

23. Privacy

Your use of this website is also governed by our Privacy Policy.

Protected Health Information may also be governed by our HIPAA Notice of Privacy Practices, where applicable.

If you become a patient, additional privacy, consent, and patient rights documents may apply.

25. No Guarantees

Modern Primary Care Plus does not guarantee:

  • That a provider will be available 24/7
  • That a specific appointment time will be available
  • That telehealth will be appropriate for your condition
  • That a specific medication, treatment, lab, imaging test, or referral will be ordered
  • That any service will produce a specific result
  • That the website will be uninterrupted, error-free, or free of harmful components
  • That third-party platforms will function without interruption

Healthcare decisions are based on clinical judgment, patient safety, applicable law, and available information.

26. Disclaimer of Warranties

The website and website content are provided on an “as is” and “as available” basis.

To the fullest extent permitted by law, Modern Primary Care Plus disclaims all warranties, express or implied, including warranties of accuracy, completeness, reliability, fitness for a particular purpose, non-infringement, merchantability, website availability, or error-free operation.

Modern Primary Care Plus may update, modify, suspend, or discontinue website content, services, membership options, pricing, visit fees, features, or policies at any time.

Your continued use of the website or services after changes are posted means you accept the updated Terms.

30. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.

Any dispute related to these Terms, the website, or services shall be handled in Florida unless otherwise required by law or stated in a signed agreement.

If any part of these Terms is found to be invalid, unlawful, or unenforceable, the remaining portions will remain in full force and effect.

32. Entire Agreement

These Terms, together with our Privacy Policy, any signed patient agreement, membership agreement, consent forms, telehealth consent, HIPAA Notice of Privacy Practices, and other applicable documents, make up the agreement between you and Modern Primary Care Plus regarding your use of the website and related services.

If a signed patient or membership agreement conflicts with these website Terms, the signed agreement will control for the subject matter covered by that agreement.
